Sir/Madam,
FSSAI is in receipt of a number of references/complaints that a number of manufacturers of Packaged Drinking Water (PDW) and Mineral Water (MW) are manufacturing the said products on FSSAI State/Central Licenses without having the BIS Certification which mandatory for the sale of such products in the country.
2. In this regard, kind reference is drawn towards the order dated 26.03.2021 issued by FSSAI vide which it was directed that FBO can upload BIS license or copy of letter indicating recording of application for BIS license on FOSCOS portal at the time of applying for new license for PDW and MW from FSSAI. It has been further directed that after obtaining BIS License, the FBO shall furnish its details in online Annual Return available in FOSCOS.
3. In view of above provisions and keeping in view the mandatory requirement of BIS Certification Mark for the sale of PDW & MW, it is requested to review the Licenses granted for manufacturing of Packaged Drinking Water and Mineral Water products under your respective jurisdictions and verify whether the said licensees have furnished the valid BIS Certificate for the same through FoSCOS portal. In cases, where such certificates are not available, notices may be issued to the FBOs to furnish the same in time bound manner failing which such licenses license may be cancelled/suspended as per FSS (Licensing and Registration of Food Businesses) Regulation, 2011.
4. The action taken report in the matter may kindly be shared with this office by 31.05.2022 positively.
